Welcome to Enhancer.photo. These Terms and Conditions (“Terms”) govern your access to and use of enhancer.photo and its AI-powered image enhancement tool (the “Service”), operated by Enhancer.photo (“we,” “us,” or “our”). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, please do not use the Service.

1. About the Service

Enhancer.photo provides a free, browser-based tool that uses artificial intelligence to enhance, sharpen, and upscale images (for example, fixing blur, pixelation, low resolution, or faded old photos). No account, sign-up, or payment is required to use the core Service.

We may update, modify, suspend, or discontinue any part of the Service at any time, with or without notice.

2. Eligibility

You must be at least 13 years old (or the minimum age of digital consent in your country) to use the Service. By using the Service, you confirm that you meet this requirement. If you are under the age of majority in your jurisdiction, you should only use the Service with the involvement of a parent or guardian.

3. Acceptable Use

You agree to use the Service only for lawful purposes. You may not upload, process, or attempt to enhance any image that:

You do not own or do not have the legal right or permission to use;
Depicts child sexual abuse material or otherwise sexualizes minors, in any form;
Is intended to harass, defame, impersonate, stalk, or harm any person;
Infringes any third party’s intellectual property, privacy, or other legal rights;
Contains illegal content, or is used to facilitate illegal activity, fraud, or deception (including fabricating or manipulating images to deceive others);
Contains malware, viruses, or code intended to damage or interfere with the Service or its infrastructure.

You also agree not to:

Attempt to reverse-engineer, scrape, or interfere with the Service or its underlying AI models;
Use automated means (bots, scripts) to access the Service in a way that places excessive load on our systems or circumvents usage limitations;
Resell, sublicense, or commercially exploit the Service itself (as opposed to the images you enhance) without our prior written consent.

We reserve the right to refuse processing, remove access, or take other action against users who violate these Terms.

4. Your Content and Ownership

You retain ownership of any photos or images you upload to the Service (“Your Content”). We do not claim any ownership rights over Your Content.
By uploading Your Content, you grant us a limited, non-exclusive, royalty-free license to temporarily process, transmit, and store Your Content solely for the purpose of providing the enhancement you requested (including sending it to third-party AI processing infrastructure where applicable).
As described in our Privacy Policy, we do not permanently store uploaded or enhanced images; files are automatically deleted after processing.
You are solely responsible for Your Content and for ensuring you have the necessary rights and permissions to upload and enhance it.

5. Intellectual Property

The Service, including its design, branding, software, AI models, and all related content (excluding Your Content), is owned by Enhancer.photo or our licensors and is protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or create derivative works based on the Service without our prior written permission.

6. No Fees; Donations

The Service is provided free of charge. We may offer an optional donation link (such as “Buy Me a Coffee”) for users who wish to support the Service voluntarily. Donations are not required to use the Service, are non-refundable, and are processed by the applicable third-party platform, which has its own terms and privacy practices.

If we introduce any paid features, plans, or services in the future, additional terms specific to those offerings will apply and will be presented to you at that time.

7. Disclaimers

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR ACCURACY.

We do not guarantee that:

The Service will be uninterrupted, error-free, or secure at all times;
Enhancement results will meet your expectations or be suitable for any particular purpose;
Any errors or defects will be corrected.

AI-based enhancement results can vary depending on the quality, content, and format of the original image, and we make no guarantee about the outcome of any specific enhancement.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, ENHANCER.PHOTO AND ITS OWNERS, EMPLOYEES, AND PARTNERS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF DATA, PROFITS, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF (OR INABILITY TO USE) THE SERVICE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

TO THE EXTENT ANY LIABILITY CANNOT BE EXCLUDED, OUR TOTAL LIABILITY TO YOU FOR ANY CLAIM ARISING FROM YOUR USE OF THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID US (IF ANY) IN THE 12 MONTHS PRECEDING THE CLAIM, WHICH — GIVEN THE SERVICE IS FREE — MAY BE ZERO.

These Terms are governed by and construed in accordance with the laws of the State of New York, USA, without regard to conflict-of-law principles, unless otherwise required by mandatory local law applicable to you as a consumer.
